"Despite their many obvious inter-connections, EU and international law are all too often studied and practised in different spheres. While it is natural for each to insist on their own unique characteristics, and in particular for the EU to emphasis it sui generis nature, important insights might be lost because of this exclusionary approach. This books aims to break through some of those barriers, to show how more interaction between the two spheres might be encouraged. In so doing, it offers a constitutional dimension but also a substantive one, identifying policy areas where EU and international law and their respective actors work alongside each other. Abstract

Le droit institutionnel de l'Union europeenne est celui d'une entite en developpement incessant depuis sa creation dans les annees cinquante. Les difficultes se sont accumulees depuis l'echec du traite etablissant une constitution pour l'Europe. La crise economique, financiere et monetaire que traverse le continent met a rude epreuve les rouages de l'Europe. Neanmoins, l'edifice resiste a l'usure du temps et de nouvelles perspectives se degagent egalement autour des droits fondamentaux et de valeurs mieux affirmees. Au fil du temps, ce droit s'est integre dans l'ordonnancement juridique general au sein duquel il se trouve en relation, mais aussi en concurrence, avec les droits nationaux des Etats membres ainsi qu'avec le droit international. La Cour de justice assure sans relache la primaute et l'unite d'interpretation du droit de l'Union ainsi que la coherence d'ensemble. Ainsi peut se degager un veritable droit commun qui irradie de nombreux secteurs de la vie sociale, professionnelle et academique.

Abstract

This book addresses the impact of EU law beyond its own borders, the use of law as a powerful instrument of EU external action, and some of the normative challenges this poses. The phenomenon of EU law operating beyond its borders, which may be termed its 'global reach', includes the extraterritorial application of EU law, territorial extension, and the so-called 'Brussels Effect' resulting from unilateral legislative and regulatory action, but also includes the impact of the EU's bilateral relationships, and its engagement with multilateral fora and the negotiation of international legal instruments. The book maps this phenomenon across a range of policy fields, including the environment, the internet and data protection, banking and financial markets, competition policy, and migration. It argues that in looking beyond the undoubtedly important instrumental function of law we can start to identify the ways in which law shapes the EU's external identity and its relations with other legal regimes, both enabling and constraining the EU's external action.

Abstract

This Dictionary analyses the ways in which the statuses of European citizens are profoundly affected by EU law. The study of one’s particular status (as a worker, consumer, family member, citizen, etc.) helps to reconsider the legal notions concerning an individual’s status at the EU level. The Dictionary includes a foreword by Evgeni Tanchev, Advocate General at the Court of Justice of the European Union, which illustrates some interesting features of the Court’s case law on statuses. The Dictionary’s core is composed of 79 chapters, published in alphabetical order. Each brief chapter analyses how the individual status was conditioned or created by contemporary EU law, or how the process of European integration modified the traditional juridical definition of the respective status. The Dictionary provides answers to the following questions: Has the process of European integration modified the traditional juridical definition of individual status? Has the concept of legal status now acquired a new function? What role has EU law played in developing a new modern function for the concept of individual status? Are the selection of a specific individual status by EU law and the proliferation of such statuses, which is synonymous with the creation of new privileges, collectively undermining the goal of achieving substantive equality between EU citizens?
